At Garrett y Asociados, we respect our clients' privacy. We have a long-standing policy of protecting the privacy of our clients in all of our business operations.

We've adopted the Canadian Standards Association's Model Code as the basis for our own Garrett y Asociados Privacy Code. It sets out the principles that govern the collection, use and disclosure of our clients' personal information.

We've created this part of our site to inform you about our privacy practices. We want you to understand the purposes for which we collect personal information about our clients. We also want to be sure that we have your consent to continue to collect, use and disclose your personal information for those purposes.The following is a brief summary of our privacy practices.


Why we collect personal information:

If you are one of our clients, Garrett y Asociados has some basic information about you. We understand that some of this information is private, which is why we collect personal information only for the following purposes:

  1. To establish and maintain a responsible commercial relationship with you and to provide ongoing service. For example, when you apply for insurance, we collect information that allows us to confirm your identity and eligibility so that we can accurately bill and collect for the insurance products and services that you receive. We may collect credit card information if you prefer the convenience of that form of payment. Credit card information is used for the specific transaction, and is not stored or retained in any way. If you need to use your credit card for another transaction, you will have to give us the information again.

  2. To understand your needs and preferences. We maintain a record of the policies and services you receive from us, and we may ask for additional information so that we can serve you better. For example, we will ask for your e-mail address and/or fax number so we can more easily communicate with you and send you notices of premiums due.

  3. To manage and develop our business and operations. For example, we analyze client usage of our website and facilities to help us manage them efficiently and plan for future growth.

  4. To meet legal and regulatory requirements. For example, we may collect information in response to a court order, or to satisfy a request by the Instituto Nacional de Seguros (the "INS") for information about a client complaint and how it was resolved.


When do we disclose personal information?

There are a few circumstances where we may need to disclose some personal information about our clients. In any case, we will only disclose the minimum information required. Here are some examples:

  1. We may disclose a client's personal information to a person who, in the reasonable judgement of Garrett y Asociados, is seeking the information as an agent of the client. For example, we may provide information about a client's account to the client's legal representative if we are satisfied that that individual is requesting the information on behalf of the client.


  2. Client information may be shared among Garrett y Asociados business units (such as Commercial Division, Personal Division, and Risk Management) to help us serve our clients better and to provide them with high quality service.


  3. We may disclose a client's personal information to:

    • A company or individual employed by Garrett y Asociados to perform functions on its behalf, such as research or data processing; or o an agent used by Garrett y Asociados to collect the client's account.


    • We may disclose a client's personal information to a public authority or agent of a public authority, if in the reasonable judgement of Garrett y Asociados, it appears that there is imminent danger to life or property which could be avoided or minimized by disclosure of the information.

Any such disclosure of a client's personal information outside of Garrett y Asociados is made on a confidential basis with the information to be used only for the purpose for which it was disclosed.


How do we protect your personal information?

In order to protect your personal information and your right to privacy, Garrett y Asociados:

  1. Will not collect, use or disclose your personal information for any purpose other than those identified above, except with your consent;

  2. Will protect your personal information with appropriate security safeguards;

  3. Will protect the confidentiality of your personal information when dealing with other companies;

  4. Will strive to keep your personal information as accurate and up-to-date as is necessary for the purposes identified above; and

  5. Will honor any reasonable request you may make for access to your personal information.


What are your choices?

We would like to have your consent to continue to collect, use and disclose your personal information for the purposes identified above. However, you do have choices and can refuse or withdraw your consent as follows:

  1. You may have your name removed from our telephone, mail or e-mail lists. However, we use these lists to inform you of upcoming premiums due and other relevant information, products, and services that may be of benefit to you. You would have to affirm in writing that you did not wish to be contacted by us for any reason, and you would take it upon yourself to make timely payments to the INS as required for maintaining your policies in effect.

  2. You may refuse to provide personal information to us. You may also withdraw your consent at any time, subject to legal restrictions and reasonable notice. However, in either case, this may limit our ability to serve you.

Depending on which areas of our website you access, you may be asked for information to help personalize your web experience. For example, we will ask you to choose a language preference. We promise to protect the information you provide online in the same way we protect all our client information.


Does Garrett y Asociados use cookies when I access the web site?

A cookie is a small, encrypted data string that our server passes to your computer to write to your hard drive, which contains your unique User ID for our web site. Garrett y Asociados may use a cookie to identify you during subsequent visits. Currently, the only function of this cookie is to remember whether you prefer to view the website in Spanish or English. You may block the placement of this cookie, but then each time you visit our site you will have to choose your language preference again. A cookie cannot be used to access or otherwise compromise the data on your hard drive. Clients who wish to disable this feature can do so by modifying their Internet preferences.
